Terms Of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“user,” “you,” or “your”) and TribeCredit Corp. (“TribeCredit,” “we,” “our,” or “us”) governing your access to and use of our mobile application (“App”) and related services (collectively, the “Services”). By using our Services, you agree to comply with these Terms. If you do not agree, please do not use the Services.

1. User Accounts

• Account Creation: To access certain features of our Services, you may need to create an account. You agree to provide accurate and complete information and update it as necessary.

• Login Security: You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account. Notify us immediately if you suspect unauthorized access.

• Age Restriction: You must be at least 18 years old to use our Services. By accessing our App, you represent and warrant that you meet this requirement.
  
  

2. Prohibited Uses

You agree not to:

• Use the Services for any unlawful purpose or in violation of applicable laws.

• Infringe on the intellectual property or privacy rights of others.

• Distribute harmful code, spam, or other malicious content.

• Attempt to interfere with the operation of the App or access unauthorized areas of the Services.

• Misuse Profile Information: Misuse of profiles—whether your own or others’—such as impersonation, misrepresentation, harassment, or unauthorized sharing, is strictly prohibited.

3. Privacy Policy

Our Privacy Policy explains how we collect, use, and protect your information. By using our Services, you also agree to the terms of our Privacy Policy.

4. Payment Terms

• Payment Processing: Payments made through the Services are processed by Stripe, Inc. (“Stripe”). By making a payment, you agree to Stripe’s Terms of Service and Privacy Policy.

• Refunds: Refunds, if applicable, will be processed at TribeCredit’s sole discretion for eligible claims, such as service errors or non-delivery. Refund requests must be made within 14 days of the transaction by contacting support@tribe.credit.

• Liability: TribeCredit is not liable for errors, delays, or disputes arising from payments processed through Stripe.
  
  

5. Third-Party Services

The Services may include integrations with third-party providers, such as Stripe and analytics tools. TribeCredit is not responsible for the actions or policies of third-party providers. Your interactions with these services are governed by their respective terms and policies.

6. Financial Aid and Donations

TribeCredit is a software platform that partners with nonprofits and communities to expand access to interest-free financial aid. TribeCredit Corp. does not issue or guarantee loans or financial aid. All financial aid is provided by participating nonprofit partners.
At this time, donation functionality in the App supports donations to TribeCredit Fund Corp., a registered 501(c)(3) nonprofit organization (Candid profile). Donations are processed securely via Stripe and go directly to the nonprofit. TribeCredit Fund Corp. issues tax receipts to donors.

7. Payment Processing Fees

TribeCredit does not charge any interest or platform fees. However, repayments are processed via Stripe, Inc., which charges a processing fee at the time of each transaction. This fee is 0.8% (ACH, capped at $5 per payment) or 2.9% + $0.30 (credit/debit card).

8. Intellectual Property

All content, trademarks, and materials provided through the Services are the property of TribeCredit or our licensors. You may not use, reproduce, or distribute any content without prior written permission.

9. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, including for violations of these Terms or applicable laws. Upon termination, your rights under these Terms will immediately cease.

10. Limitation of Liability and Indemnity

• The Services are provided “as is” and “as available.” To the fullest extent permitted by law, TribeCredit disclaims all warranties, express or implied, except those that cannot legally be disclaimed.

• TribeCredit is not liable for indirect, incidental, or consequential damages arising from your use of the Services.

• You agree to indemnify and hold harmless TribeCredit, its affiliates, officers, directors, employees, agents, and representatives from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of:
  
  

  1. Your use of the Services.
     
     

  2. Your violation of these Terms.
     
     

  3. Your infringement of any third-party rights, including intellectual property or privacy rights.
     This obligation survives the termination of your account or these Terms.

11. Dispute Resolution

By using the Services, you agree to resolve disputes through binding arbitration in accordance with the laws of the State of Florida, unless otherwise required by applicable law. You waive the right to a jury trial or to participate in a class action.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting an updated version with a new “Effective Date” and, where appropriate, notifying you through the App. Your continued use of the Services constitutes your acceptance of the updated Terms.
